Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Ever Us mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated through the Service or by other reasonable means. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Description of the Service

Ever Us is a private memory timeline application designed for couples. The Service allows two users to create a shared timeline of memories, including photos and notes. The Service is intended for personal, non-commercial use only.

3. Account Registration

To use the Service, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete information during registration
• Notify us promptly of any unauthorized access to or use of your account
• Not create an account on behalf of another person without their consent

4. User Responsibilities

When using the Service, you agree that you will:

• Use the Service only for its intended purpose as a private couple memory journal
• Not upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Not attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service
• Not use the Service to harass, stalk, or intimidate any person
• Not use automated means to access or interact with the Service without our prior written consent
• Comply with all applicable local, national, and international laws and regulations

5. Partner Invitation

The Service includes a partner invitation feature that allows you to invite one other individual to share a timeline with you. By sending an invitation, you represent that you have the consent of the recipient to share a timeline together. Both users in a couple have equal access to the shared timeline and its contents.

6. Content Ownership

6.1 Your Content

You retain full ownership of all content you upload, create, or share through the Service, including photos and memory notes ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the Service.

6.2 Shared Content

Content added to a shared timeline is visible to both users in the couple. Each user retains ownership of the content they individually created. We do not claim ownership of any User Content.

6.3 Our Content

All intellectual property rights in the Service itself — including its design, branding, code, and documentation — remain the exclusive property of Ever Us. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand elements.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

8. Account Termination

8.1 Termination by You

You may delete your account at any time through the application settings or by contacting us. Upon deletion, your data will be handled in accordance with our Data Deletion Policy.

8.2 Termination by Us

We reserve the right to suspend or terminate your account if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or used the Service in a manner that could harm other users or the integrity of the Service. Where possible, we will provide notice and an explanation before taking such action.

8.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We are not obligated to retain your User Content after account termination, except as required by applicable law.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Ever Us and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service.

In no event shall our total liability to you exceed the amount you have paid to us, if any, for use of the Service during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ever Us and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ever Us is established, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of that jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
